Fast-track examination for trademark applications in Brazil

On August 7, 2025, the Brazilian Patent and Trademark Office (BRPTO) will launch a new service that allows for a trademark fast track examination. This program aims to expedite the examination of trademark applications and new filings that meet legal requirements or are in line with strategic objectives and public policies.  

There will be two expedited programs:

Legal priority cases, free of charge, allowed for:

  • Individuals aged 60 and older;
  • Applicants with significant illnesses;
  • Applicants with disabilities;
  • Small Brazilian companies.

Strategic and public policy cases (subject to quota limits):

Applicants who filed oppositions based on prior rights;

  • Applicants who need to register a trademark to receive public funds;
  • Trademark applications in court proceedings;
  • Trademarks associated with goods/services protected by fast-tracked patents;
  • ICTs (Institutions for Science, Technology, and Innovation);
  • BRPTO’s mentees under the Technical Cooperation Agreement;
  • Issues of public interest or national emergencies.

This new mechanism will make the Brazilian trademark system more efficient.
