The Brazilian PTO announces an increase in official fees that will enter into force on August 07, 2025

On May 13, 2025, Ordinance No. 110 regarding the Brazilian Patent and Trademark Office’s (BRPTO) 24.1% increase in official fees was published in the Official Bulletin No. 2836.

The new fee schedule will enter into force on August 7, 2025. After more than 11 years without changes, this adjustment, the first since 2014, brings official fees up to date.

Some key updates are highlighted as follows:

Patents:

  • The fee for issuing a letters patent or certificates of addition of invention will be deleted as of December 20, 2025.
  • Introduction of new items, such as the withdrawal of appeals and petitions.

Trademarks:

  • Priority examination for applications eligible for fee waivers or based on strategic/public policy reasons.
  • Submission of evidence for acquired distinctiveness.
  • Limited-scope oppositions, restricted to conflicts based on registered trademarks.
  • Grant fees will be deleted as of September 20, 2025.
  • The new announced fee schedule is silent on multiclass trademarks.

Lastly, full exemption (100%) continues for underprivileged individuals and persons with disabilities registered in the official Federal Government databases.
